This is a case of a lady who was about to lose her property on the basis of a forged power of attorney. On filing a case in the court of law she was able to get back her property. Mrs. Doris Victor was the owner of a plot in Valliyoor Village. She filed a complaint against one Mr. R. Jawaharaj alleging that he created a false power of attorney and tried to transfer her property and get benefit by way of mortgaging the said property.

Mrs. Doris Victor filed a criminal complaint against R. Jawaharaj and alleged that with the aid of a sham person who by impersonating as Mrs. Doris Victor created a Power of Attorney in the favour of R. Jawaharaj as her agent and using the aforesaid Power of Attorney, R. Jawaharaj attempted to transfer the property of complainant by executing a mortgage deed in favour of Rajapandi for a sum of Rs.50,000/-.Hence she filed a complaint against R. Jawaharaj. Unfortunately Mrs. Doris Victor passed away after filing of the complaint. There after the daughter of the deceased Doris Victor filed an appeal before Supreme Court and succeeded in proving that the respondent by way of forgery created power of attorney in his favour with the sole intention of grabbing the property belonging to Mrs. Doris Victor. Narayanan Pillai, who is a document writer, stated that on 08.12.1997, both the accused accompanied a woman who identified herself as Mrs. Doris Victor and approached him to execute a Power of Attorney in favour of R. Jawaharaj (respondent). After the said document was made, two witnesses put their signatures along with R. Jawaharaj and got the document registered in the office of Sub Registrar, Panangudi. Moreover the appellant too got succeeded in establishing that R. Jawaharaj and Rajapandi executed a mortgage deed in respect of the said property for an amount of Rs. 50,000/.The said deed was registered in the office of the Sub-Registrar, Valliyoor. With the help of forensic experts and handwriting experts it was established that the signatures and the thumb impression was not of Mrs. Victor. The court held that the power of attorney was a forged document hence the mortgage deed was canceled.
